OAH conducts fair hearings for most divisions of DHHS including: Division of Child and Family Services (DCFS), Division of Services for People with Disabilities (DSPD), Office of Recovery Services (ORS), Division of Licensing and Background Checks, and Adult Protective Services.  Hearing requests are received within their respective divisions and forwarded by the agency to the Office of Administrative Hearings (OAH). Hearing requests must be filed by the filing deadline

• DCFS and APS: 30 days from the date of service of the Notice of Agency Action.
• Other: 15 calendar days from the date of service of the Notice of Agency Action unless a statute or rule provides otherwise. The Notice of Agency Action should indicate the deadline.

How to request an administrative hearing

Most agencies provide you a hearing request form when they send you a Notice of Agency Action.
